Selling or Buying a Property in Bengaluru from Abroad Through a Power of Attorney - Step by Step Process.

Written by Dinesh Ramachandra Reddy – Deeds & Co.3 min read

A Power of Attorney executed abroad enables Non-Resident Indians (NRIs) and overseas property owners to authorise a trusted person in India to represent them in property transactions, documentation and registration formalities.

However, a Power of Attorney executed outside India must comply with applicable authentication procedures and Karnataka stamp laws before it can be used for property-related transactions. The following is a step-by-step guide to executing a Power of Attorney abroad and completing its adjudication at the District Registrar Office (DRO), Bengaluru.

Step-by-Step Process

Step 1: Drafting the Power of Attorney

Engage an experienced property lawyer in Bengaluru to draft the Power of Attorney according to the intended purpose. The document must clearly specify the powers granted to the Attorney Holder, property details and scope of authority.

Step 2: Execution and Authentication Abroad

Once the draft is finalized, the executant shall take the prints on A4 size bond sheets and must sign the document before the competent authority in their country of residence. Depending on the applicable procedure, it must be notarised and apostilled or attested by the Indian Embassy or High Commission.

Step 3: Sending the Original Document to India

After completing the authentication formalities, the original Power of Attorney must be couriered to the Attorney Holder in Bengaluru or their respective location in India.

Step 4: Signature by the Attorney Holder

Upon receiving the original document, the Attorney Holder must sign at the designated place provided for their signature, wherever required. Thereafter, the Attorney Holder shall personally carry the original document to the jurisdictional District Registrar Office for adjudication.

Step 5: Submission for Adjudication

The Attorney Holder must submit the original Power of Attorney along with the prescribed application and supporting documents before the concerned District Registrar Office. The authority examines the document under the Karnataka Stamp Act, 1957, and determines the applicable stamp duty.

Step 6: Supporting Documents

The following documents should generally be kept ready

  1. Original foreign-executed Power of Attorney.
  2. Apostille or Indian Consular attestation note.
  3. Aadhaar and Passport copy of the Executant and Attorney Holder.
  4. Relationship Proof of executor and attorney holder in case of selling purpose.
  5. Relevant property documents, wherever applicable.
  6. Stamp duty paid receipt (K2 Challan)
  7. Prescribed application and supporting declarations.

Step 7: Payment of Stamp Duty and Adjudication

Upon scrutiny, the authority determines the applicable stamp duty. The Attorney Holder must pay the assessed duty through the prescribed government payment mechanism. The adjudication endorsement or certificate is subsequently obtained, subject to the authority's requirements.

1. Power of Attorney for Sale of Immovable Property

Under Article 41(eb) of the Karnataka Stamp Act, 1957, where a Power of Attorney authorising the sale of immovable property in Karnataka is granted to a person other than the executant's father, mother, husband, wife, son, daughter, brother or sister, stamp duty is chargeable at the same rate as a conveyance under Article 20(1), calculated on the market value of the property.

2. Joint Ownership of Property

Where a property is jointly owned by husband and wife or other co-owners, each owner should execute a separate Power of Attorney in favour of their respective Attorney Holder, authorising representation in respect of their individual undivided share.

3. Power of Attorney for Other Purposes

For purposes other than the sale of immovable property, such as property purchase, management, document collection, case representation, municipal applications and other administrative requirements etc., a Power of Attorney may generally be granted to any suitable person, irrespective of blood relationship, subject to applicable nominal stamp-duty and legal requirements.

Conclusion

Executing a Power of Attorney abroad and completing its adjudication at DRO Bengaluru requires proper legal drafting, authentication, documentation and compliance with Karnataka stamp laws. Professional legal assistance helps ensure that the document is appropriately structured and processed, reducing potential complications during property transactions and registration.

Consult an experienced property lawyer in Bengaluru before executing a Power of Attorney to ensure legal compliance and appropriate stamp-duty treatment.
